  • What makes the EB-5 Visa program different from the L-1 (manager transfer) or E-2 (Treaty Investor)?
  • Participation in the EB5 Visa Immigrant Investor programs gives qualified applicants permanent resident status (green card). Permanent residency requires no renewal or re-application. The E-1 Treaty Investor or E-2 Treaty Trader programs allow for nonimmigrant status only. When the qualifying business/investment ends, so does the non-immigrant status that has been granted to the alien.
  • What information and documentation are required?
    • Evidence that an applicant has lawfully invested in a Regional Center project.
    • Evidence that an applicant has invested or are actively investing the amount required.
    • Evidence that capital was obtained through lawful means.
    • Evidence that the enterprise will create at least 10 jobs during a two year period.
  • Can money gifted by a parent or other relative be used for an EB-5 Investment?
  • Yes. It must be demonstrated that the gift is an actual arm’s length transaction and is a not a mere ruse or that the gifted funds will be given back after permanent resident status is granted.
  • Family Relationships and the EB-5 Visa
  • The investor’s spouse may accompany or follow to join an investor who has been granted conditional lawful permanent residence provided that the investor and the spouse, deemed a derivative beneficiary, were married at the time of the investor’s first admission to the United States, as a conditional lawful permanent resident or following adjustment of status to lawful permanent residence.

    Children or step-children of the investor may accompany or follow to join an investor who has been granted conditional lawful permanent residence, provided that the investor can establish parentage or step-parentage at the time of the investor’s first admission to the United States, as a conditional lawful permanent resident or adjustment of status to lawful permanent residence. Note: A “child” is someone under the age of 21 years who is unmarried.

  • What is the EB-5 Program?
  • The EB-5 Investment Visa Program is the immigrant visa category for foreign entrepreneurs and investors. Through the EB-5 program, a foreign national can obtain lawful permanent resident status in the United States for himself / herself, a spouse and unmarried children under age 21, in return for making a qualified investment in a U.S. enterprise.
  • The main requirements of the EB-5 program are:
    • The applicant must invest a minimum of either USD$1,000,000 or USD$500,000 in a commercial enterprise. The minimum investment is USD$500,000 for investments that are located in a Targeted Employment Area, or TEA, which refers to areas that have experienced high unemployment, as well as certain rural areas.
    • The investment funds must be at risk.
    • The investment results in the creation of ten (10) full-time (at least 35 hours per week) jobs for U.S. workers, over a two-year period.
  • What is a designated regional center?
  • A Designated Regional Center is an entity or economic unit, public or private, approved by the United States Citizenship and Immigration Service (USCIS) to facilitate the sourcing of capital by multiple EB-5 investors. Each Designated Regional Center focuses on specific geographic areas within the U.S. and seeks to promote economic growth and creation of new jobs in that area.
  • Do I have to be involved in the day-to-day management of my investment?
  • No. The EB-5 regulations do not require the investor to be involved in management or policy-making in the enterprise.
